Complexities in Child Support

The level of child support is based on the incomes of the parents, the residency of the child, and taking into account cost of childcare, health insurance and any other recurring expenses. The determination of the child support level is likely a routine process where both parents report wages from an employer.

Unfortunately, other circumstances can make the determination process more complex, such as when a parent is self-employed, owns a business or receives compensation in cash. In these cases, I thoroughly examine the true income for the self-employed person to determine the accurate support level, or defend efforts by the other parent seeking an increase in support.

When the court issues a child support order, the order stands until the court is presented with other information. When a significant change in circumstances occurs, for example due to a layoff, promotion or emancipation of a child, one of the parties can seek a modification in the child support level.
